Visual Aid Corporation iOS Apple App Store License Agreement

1. Introduction

This License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and Visual Aid Corporation ("Company," "we," "us," or "our") regarding your use of our proprietary application ("Application"). By downloading, installing, or using the Application, you agree to be bound by the terms of this Agreement.

2. License Grant

Subject to the terms and conditions of this Agreement, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the Application solely for your personal or professional medical use, in accordance with applicable laws and regulations. You agree not to use the Application for any other purpose.

3. Ownership and Intellectual Property

All rights, title, and interest in and to the Application, including but not limited to all intellectual property rights, are and shall remain the exclusive property of Visual Aid Corporation. This Agreement does not grant you any ownership interest in the Application.

4. Privacy and Data Usage

We are committed to protecting your privacy. We will only access or use your data with your explicit consent, in accordance with our Privacy Policy. Your data will be used solely for purposes you have approved, such as enhancing your experience with the Application or for necessary support and maintenance.

5. Restrictions on Use

You agree not to:

5.1 Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Application.

5.2 Modify, adapt, translate, or create derivative works based on the Application.

5.3 Rent, lease, loan, sell, redistribute, or sublicense the Application.

5.4 Use the Application in any manner that violates any applicable laws or regulations.

6. Termination

This Agreement is effective until terminated by you or Visual Aid Corporation. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any term(s) of this Agreement. Upon termination, you shall cease all use of the Application and delete all copies from your devices.

7. Disclaimer of Warranties

The Application is provided "as is" and "as available," without warranty of any kind. Visual Aid Corporation disclaims all warranties, whether express, implied, or statutory, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the maximum extent permitted by law, in no event shall Visual Aid Corporation be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Application; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Visual Aid Corporation is incorporated, without regard to its conflict of law principles.

10. Amendments

Visual Aid Corporation reserves the right to modify or replace this Agreement at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the Application after any such changes constitutes your acceptance of the new Agreement.
